These Terms of Service and Travel Advisor Agreement ("Terms") govern consulting, travel planning, booking coordination, and related services provided by ZT Management Limited Company, a New Mexico limited liability company doing business as Ben's Travel ("Ben's Travel," "we," "us," or "our"). Our business mailing address is 1209 Mountain Road Pl NE, Ste R, Albuquerque NM 87110.
1. Agreement to These Terms
You agree to these Terms when, after receiving notice of them, you:
- Check a box expressly accepting them;
- Sign or electronically accept a consulting agreement, booking authorization, or payment authorization incorporating them;
- Submit payment after being informed that payment constitutes acceptance; or
- Otherwise provide written or electronic acceptance.
You must be at least 18 years old and legally capable of entering into a contract. If you act for another traveler, business, or group, you represent that you have authority to provide instructions and payment authorization on its behalf. You are responsible for distributing applicable booking terms to each traveler, although you may not waive another traveler's nonwaivable legal rights.
Electronic Acceptance and Records
These Terms and related documents may be presented, accepted, and signed electronically. Clicking an acceptance control, typing your name, signing through an electronic signature service, replying in writing with your approval, or submitting payment after notice each has the same effect as a handwritten signature, to the extent permitted by the federal E-SIGN Act and applicable state law.
With your affirmative consent, Ben's Travel may deliver these Terms, authorizations, confirmations, invoices, and legally required disclosures electronically. Unless a consent presented for a particular transaction states otherwise, your consent applies to these categories of records for your current and future engagements with Ben's Travel until you withdraw it.
Before consenting, you must be able to access and retain the electronic disclosure containing this provision. You will need:
- A computer, smartphone, tablet, or similar device with a reliable internet connection;
- A current web browser capable of securely displaying webpages;
- An active email account that you can access;
- Software capable of opening HTML documents and PDF files; and
- Sufficient electronic storage or access to a printer to retain copies for your records.
When applicable law requires E-SIGN consumer consent, Ben's Travel will obtain your consent electronically in a manner that reasonably demonstrates your ability to access the format in which the records will be provided. If the hardware or software requirements materially change in a way that may prevent access, we will provide the revised requirements and obtain renewed consent when required by law.
You may request a paper copy of any electronic record at no charge, withdraw your consent to future electronic delivery, or update your email address by contacting office@benstravel.com or writing to the mailing address in Section 24. Withdrawal applies prospectively and does not affect the validity of records previously provided or accepted. Withdrawal will not itself terminate an existing booking, but we may require paper communications or decline a future engagement if electronic delivery is reasonably necessary to provide the requested service. We will disclose any different consequence before obtaining consent.
2. Our Services and Role
Ben's Travel provides travel consulting, research, planning, advisory, booking, reservation, modification, cancellation-assistance, and coordination services.
At your direction and subject to availability and applicable rules, we may arrange, reserve, modify, or cancel travel with airlines, hotels, resorts, cruise lines, tour operators, transportation companies, excursion providers, insurers, destination-management companies, and other independent providers ("suppliers").
We may access a supplier through WorldVia or through an authorized third-party booking channel, including an online travel agency, wholesaler, consolidator, bed bank, destination-management company, marketplace, or other intermediary (each a "booking intermediary"). For example, hotel accommodations supplied by a hotel may be reserved through an online travel agency rather than directly with the hotel.
Ben's Travel is an independent travel agency affiliated with WorldVia Travel Network, a Travel Leaders Network agency. Travel may be booked through WorldVia's credentials, systems, supplier appointments, and accreditation. Ben's Travel acts as an independent intermediary and does not own, manage, operate, or control WorldVia or any supplier.
Unless expressly agreed in a separate written contract, Ben's Travel does not operate escorted tours, supervise travelers at a destination, or act as an on-site group manager. Nothing in these Terms excludes responsibility that applicable law imposes on Ben's Travel for its own conduct.
3. WorldVia and Seller-of-Travel Disclosures
For travel sold through WorldVia's credentials, Ben's Travel acts on behalf of WorldVia Travel Network as an independent agency. WorldVia Travel Network maintains the following registrations:

Registration as a seller of travel does not constitute approval by the State of California.
WorldVia Travel Network is not a participant in the California Travel Consumer Restitution Fund.

Ben's Travel is not independently registered under WorldVia's registration numbers and will not represent that those registrations were issued directly to Ben's Travel. We will make any transaction-specific disclosures, independent-agent filings, or additional registrations required by applicable law or WorldVia's compliance procedures.
Restricted Jurisdictions
Ben's Travel does not knowingly direct marketing to, offer travel for sale to, or accept travel bookings from a person located or residing in a jurisdiction that requires a registration, license, or filing that is not satisfied through WorldVia or otherwise held or completed by Ben's Travel.
We may decline, suspend, or cancel a proposed transaction if we determine that an applicable registration or other legal requirement has not been satisfied. If we cancel before travel services are confirmed, amounts collected for services not provided will be returned as required by applicable law. This policy does not waive or eliminate any registration, disclosure, or consumer-protection requirement that otherwise applies.
4. Consulting Services and Fees
Consulting services may include meetings, research, itinerary development, destination information, supplier comparisons, planning assistance, and other travel-related knowledge or advice.
Before paid consulting begins, we will provide or confirm the applicable hourly rate, billing increment, appointment length, and any material scope limitations. Additional research or work outside an appointment may require separate authorization.
Consulting fees are separate from supplier travel charges and separate from commissions or other compensation Ben's Travel may receive from third parties. Consulting and service fees will be processed through WorldVia or using WorldVia-approved systems or credentials when required by WorldVia or applicable law. A fee charged by Ben's Travel is for the disclosed consulting or service work and is not a payment for supplier travel unless expressly identified otherwise and lawfully processed.
Fees for consulting work already performed are nonrefundable. Unless a written proposal states otherwise, prepaid consulting time is nonrefundable if you cancel, reschedule, change your plans, decide not to book, or do not use the available time, except where applicable law requires otherwise.
If Ben's Travel cancels or reschedules a prepaid appointment, you may accept the new appointment time or request a refund of the amount paid for that appointment. If Ben's Travel terminates the consulting engagement, we will refund all prepaid fees for consulting time not yet provided.
5. Supplier Prices and Availability
Supplier prices, promotions, taxes, resort fees, port charges, fuel supplements, gratuities, foreign-exchange calculations, schedules, availability, room or cabin categories, and other terms may change before confirmation and, when permitted by the supplier's terms or applicable law, after confirmation.
A quote or proposed itinerary is informational and does not create a reservation or guarantee availability. A booking is confirmed only when the applicable supplier or authorized booking intermediary issues confirmation and any required deposit or payment has been successfully processed.
Ben's Travel will not knowingly exceed an authorized amount. If the price or material terms change before confirmation, we will request additional approval unless your written authorization expressly permits a stated variation.
Booking Channels and Intermediaries
Unless we agree otherwise in writing, Ben's Travel may select the lawful and authorized booking channel it reasonably considers appropriate for a reservation. The selected channel may affect price, cancellation procedures, loyalty-program eligibility, upgrades, credits, customer service, refund processing, and the party shown as merchant on a payment-card statement.
Ben's Travel is not required to disclose confidential commission amounts, negotiated compensation, or proprietary sourcing methods unless applicable law requires disclosure. At the time authorization is obtained, it may not be possible to determine whether a charge will ultimately be processed by the supplier, WorldVia, a booking intermediary, or a payment processor. We will identify any such party that is known and required to be disclosed at that time.
Supplier and booking intermediary terms both apply where a reservation is made through an intermediary.
6. Booking and Payment Authorization
Before we submit a booking, you must approve the material transaction details, which may include:
- Traveler names;
- Supplier and itinerary;
- Dates and destinations;
- Price and currency;
- Deposit and future-payment schedule;
- Cancellation and change terms;
- Insurance selection or declination; and
- Any nonrefundable components.
By approving a booking or payment authorization, you authorize Ben's Travel to transmit the information reasonably required by WorldVia, the supplier, or a lawful booking intermediary or payment processor selected to complete the approved travel and to request the approved charges.
Supplier travel charges are generally processed directly by the applicable supplier; when applicable law or WorldVia's procedures require host-agency processing, they are processed through WorldVia.
Unless an invoice identifies Ben's Travel as the merchant, the charge may appear on your card statement under the name of the supplier, WorldVia, or another booking intermediary.
A payment authorization may cover one or multiple charges by suppliers, WorldVia, booking intermediaries, or payment processors up to a stated aggregate maximum. The exact allocation or charging party may not be known when authorization is given. The combined charges may not exceed the authorized amount and must relate to the approved travel services. Authorization is required for an increase above the aggregate cap, materially different travel services, or materially less favorable cancellation or refund terms.
You are responsible for reviewing all names, dates, destinations, amounts, and other details before approval. You represent that information supplied for you and other travelers is accurate and that you are authorized to provide it.
7. Supplier Terms
Every booking is subject to the applicable supplier's and booking intermediary's contracts, fare rules, conditions of carriage, cancellation provisions, refund rules, deadlines, and liability limitations.
You agree to review those terms before authorizing payment. If supplier or booking intermediary terms conflict with these Terms regarding the travel product or booking channel, those third-party terms govern that product or channel. These Terms continue to govern Ben's Travel's separate services and relationship with you.
Some purchases are refundable or changeable, while others are partially or entirely nonrefundable. No purchase should be assumed refundable unless the applicable supplier's written terms state that it is.
8. Changes, Cancellations, and Refunds
You must promptly notify us if you want to request a change or cancellation. A request is not effective until received, processed, and confirmed by the applicable supplier or booking intermediary.
Supplier and booking intermediary penalties, price differences, cancellation fees, change fees, and refund timing are controlled by the applicable third party and applicable law. Ben's Travel will provide reasonable assistance with a permitted change, cancellation, credit, or refund but cannot guarantee that a supplier or booking intermediary will grant one.
Refunds for amounts charged directly by a supplier or booking intermediary ordinarily must be issued by that party. Refunds for amounts processed through WorldVia ordinarily must be handled according to WorldVia's and the applicable third party's procedures. Ben's Travel is not responsible for a supplier's or booking intermediary's processing time, insolvency, refusal, or failure to issue a refund, except to the extent a refund obligation is independently imposed on Ben's Travel by law.
If travel services are canceled through no fault of the traveler, any refund rights provided by applicable seller-of-travel or other consumer-protection law remain unaffected.
9. Credit Card Questions and Disputes
If you believe a charge is incorrect, please contact Ben's Travel promptly so we can investigate and attempt to resolve the issue.
Nothing in these Terms restricts your right to report unauthorized charges, billing errors, fraud, non-delivery, or other disputes protected by applicable law or card-network rules. You will not be penalized merely for making a good-faith payment dispute.
If a dispute is submitted, you authorize Ben's Travel to provide relevant transaction records to WorldVia, the supplier, payment processor, card issuer, bank, or dispute administrator. Those records may include the accepted Terms, booking and payment authorizations, communications, confirmations, scheduling records, and proof of services.
10. Travel Insurance
Ben's Travel strongly recommends that travelers consider travel insurance appropriate to their circumstances, potentially including trip cancellation, interruption, delay, emergency medical, evacuation, and baggage protection.
Insurance is optional and is not required to purchase other services from Ben's Travel. You may obtain insurance from any provider.
Ben's Travel and its unlicensed personnel are not insurance agents and do not interpret policy language, compare existing coverage, determine whether coverage is adequate, or provide advice regarding specific policy terms. Questions about coverage, exclusions, claims, or suitability will be referred to the insurer or a licensed insurance producer where required.
Ben's Travel may receive compensation related to an insurance purchase. Any such material connection will be disclosed as required.
You are responsible for reviewing policy terms, exclusions, coverage limits, purchase deadlines, and claim requirements. No representation is made that a policy will cover any particular event or loss.
11. Traveler Responsibilities
You are responsible for:
- Verifying every traveler's legal name and booking details;
- Obtaining and carrying valid passports, visas, permits, identification, health documents, and other required documentation;
- Checking entry, transit, exit, vaccination, and testing requirements through official sources;
- Reviewing airline schedules, baggage rules, check-in requirements, and supplier communications;
- Evaluating destination conditions and personal safety;
- Determining each traveler's health, mobility, accessibility, and fitness to travel; and
- Promptly notifying us of errors or required accommodations.
Ben's Travel may share general information, personal observations, or links to third-party resources. Such information is not legal, medical, immigration, insurance, or official safety advice and may change without notice. Travelers should verify requirements with relevant governments, embassies, health authorities, suppliers, and qualified professionals.
Ben's Travel is not responsible for losses caused by inaccurate or incomplete information supplied by a customer or traveler, except to the extent Ben's Travel independently caused or contributed to the error.
12. Travel Risks and Events Beyond Our Control
Travel involves risks including illness, injury, crime, theft, transportation hazards, inadequate medical care, infectious-disease exposure, political instability, and other known or unknown conditions.
Weather, natural disasters, government actions, border closures, war, terrorism, civil unrest, epidemics, strikes, mechanical failures, supplier insolvency, schedule changes, and other events outside Ben's Travel's reasonable control may cause delays, cancellations, quarantine, denied boarding, additional expenses, or loss of travel time.
Ben's Travel is not liable for an external event it did not cause or control. This provision does not excuse Ben's Travel from performing obligations that remain reasonably possible or providing refunds required by applicable law.
Assumption of Risk
By booking travel or using our services, you acknowledge these risks and accept them voluntarily for yourself and for each traveler you are authorized to represent. You are responsible for evaluating whether a particular trip, activity, destination, or supplier is appropriate for each traveler's health, mobility, experience, and risk tolerance.
This acknowledgment does not release Ben's Travel from liability for its own fraud, willful misconduct, gross negligence, or material booking error, or from any liability or remedy that applicable law does not permit to be excluded or limited. Liability that Ben's Travel does have remains subject to Section 17.
13. Supplier and Booking Intermediary Responsibility
Suppliers and booking intermediaries are independently responsible for their acts, services, representations, warranties, negligence, delays, schedule changes, cancellations, overbookings, substitutions, financial defaults, and other performance.
Ben's Travel is not liable merely because a supplier or booking intermediary fails to perform. This does not limit liability arising from Ben's Travel's own fraud, willful misconduct, gross negligence, or material booking error, or any liability or remedy that applicable law does not permit to be excluded or limited. Liability that Ben's Travel does have remains subject to Section 17.
14. Compensation and Advertising Disclosures
Ben's Travel may receive commissions, referral fees, affiliate compensation, sponsored-travel benefits, hosted or discounted travel, advertising payments, marketing benefits, gifts, or other consideration from suppliers, booking intermediaries, and other third parties. We may receive compensation for choosing or completing a booking through a particular authorized booking intermediary.
This compensation is separate from consulting fees and does not increase a supplier's price unless disclosed.
When required, Ben's Travel will clearly and conspicuously disclose a material connection in or near the relevant recommendation, link, review, post, video, email, or other communication. These Terms provide additional general notice but do not replace a disclosure required in the individual communication.
Recommendations reflect our good-faith opinions and available information. Compensation may be one factor in the options available to us, but you remain responsible for determining whether a recommendation is appropriate.
15. Privacy and Data Security
Our Privacy Policy is available at https://www.benstravel.com/privacy and is incorporated into these Terms by reference.
To perform our services, we may share personal information with WorldVia, Travel Leaders Network, disclosed booking intermediaries, suppliers, insurers, payment providers, technology providers, government authorities, and other parties reasonably involved in planning or providing travel. Payment-card information will be transmitted only to a party authorized in the applicable booking or payment authorization. International travel may require information to be processed in countries with different privacy laws.
We use reasonable safeguards appropriate to the sensitivity of the information. Customers should submit payment-card, passport, identification, health, and other sensitive information only through an approved secure method, not ordinary email, text message, or social-media messaging.
Nothing in these Terms limits rights or remedies arising from a privacy or data-security law that cannot be waived.
16. Customers Outside the United States
Ben's Travel is a United States business and markets its services primarily to customers in the United States. We do not maintain an office or actively solicit consumers outside the United States. If a person residing outside the United States independently requests our services, we may accept or decline the engagement.
Our services are provided from the United States and are governed by these Terms, subject to any mandatory law that cannot lawfully be excluded. Ben's Travel does not represent that its services are registered, licensed, or specifically adapted for consumers in a country outside the United States. Nothing in these Terms waives a consumer protection that applicable law does not permit the parties to waive.
17. Disclaimers and Limitation of Liability
PLEASE READ THIS SECTION CAREFULLY. IT DISCLAIMS CERTAIN WARRANTIES AND LIMITS BEN'S TRAVEL'S LIABILITY.
Sections 12 and 13 describe what Ben's Travel is and is not responsible for. This Section describes the warranties Ben's Travel does not give and the limits that apply to remedies where Ben's Travel is responsible.
Ben's Travel provides its consulting, planning, and coordination services with reasonable care and skill. Except for that commitment and any warranty applicable law does not permit to be disclaimed, our services are provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Ben's Travel does not warrant the quality, safety, accessibility, or suitability of any supplier, booking intermediary, destination, accommodation, vessel, aircraft, vehicle, activity, or insurance product. Supplier and booking intermediary performance is addressed in Section 13. Information about suppliers and destinations comes from third parties and public sources and may change or prove inaccurate without notice.
To the fullest extent permitted by law, Ben's Travel will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from its services, including loss of enjoyment, lost vacation time, missed events, inconvenience, or lost profits.
To the fullest extent permitted by law, Ben's Travel's aggregate liability arising from a particular consulting engagement or trip will not exceed the total consulting fees and commissions actually received and retained by Ben's Travel in connection with that engagement or trip.
These limitations do not apply to Ben's Travel's own fraud, willful misconduct, or gross negligence, to obligations imposed by applicable seller-of-travel law, or to any liability or remedy that applicable law does not permit to be excluded or limited.
Booking Errors
If Ben's Travel makes a material error in a booking it submits — including an incorrect name, date, destination, supplier, occupancy, or fare basis that you did not approve — Ben's Travel will promptly use reasonable efforts to correct it with the applicable supplier or booking intermediary at no additional consulting charge.
Where the error cannot be corrected without cost, Ben's Travel will be responsible for the direct out-of-pocket cost of correction, including change fees, rebooking costs, and any fare or rate difference attributable to the error, up to $1,000 per affected traveler and not more than $2,000 for any single booking. That amount is in addition to the aggregate limit stated above in this Section and is Ben's Travel's entire responsibility for a booking error, except for Ben's Travel's own fraud, willful misconduct, or gross negligence, and except for any liability or remedy that applicable law does not permit to be excluded or limited.
This provision does not apply to an error in information you supplied, an error you approved under Section 6, or a change made by a supplier or booking intermediary.
18. Indemnification
You will indemnify and hold harmless Ben's Travel and its owners, employees, and contractors from third-party claims, losses, and reasonable costs to the extent they arise from:
- Your breach of these Terms;
- Inaccurate, incomplete, or unauthorized information you provide about yourself or another traveler;
- Your submission of another person's information or payment method without authority; or
- Your or a traveler's unlawful conduct or violation of a supplier's terms.
This obligation does not apply to the extent a claim arises from Ben's Travel's own negligence, error, fraud, or willful misconduct, and does not apply where applicable consumer-protection law limits or prohibits indemnification by a consumer. Ben's Travel will notify you promptly of any claim, will not settle without your consent, and will cooperate reasonably in the defense.
19. Informal Dispute Resolution
Before filing arbitration or litigation, a party must send the other a written notice describing the dispute, supporting facts, requested relief, and relevant contact information.

The parties will attempt in good faith to resolve the matter for 30 days after receipt. This requirement does not prevent either party from seeking emergency relief, preserving a limitations period, making a protected payment dispute, or filing a qualifying small-claims case.
20. Binding Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL ARBITRATION AND GENERALLY WAIVES THE RIGHT TO A JURY TRIAL OR CLASS ACTION.
Except for qualifying small-claims matters and claims that applicable law does not permit to be arbitrated, disputes arising from these Terms, Ben's Travel's services, bookings, payments, communications, or the parties' relationship will be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA").
The Federal Arbitration Act governs this arbitration agreement.
For services obtained primarily for personal, family, or household purposes, the AAA Consumer Arbitration Rules and Consumer Due Process Protocol apply. For a genuine business-to-business transaction, the AAA Commercial Arbitration Rules apply.
Arbitration fees and costs will be allocated under the applicable AAA rules and applicable law. When the Consumer Rules apply, the consumer will not be required to pay more than the consumer filing fee allowed by those rules, and Ben's Travel will pay the amounts the rules require the business to pay. Each party will ordinarily bear its own attorneys' fees, except where a contract, statute, or arbitration award lawfully provides otherwise.
Proceedings may occur by video, telephone, written submissions, or another permitted method. Any in-person consumer proceeding will occur at a reasonably convenient location determined under the Consumer Rules.
Either party may bring an individual claim in a court of competent small-claims jurisdiction if the claim qualifies.
The arbitrator may award any individual remedy available in court. Claims must be brought individually. Neither party may participate as a plaintiff or class member in a class, collective, consolidated, private-attorney-general, or representative arbitration to the extent such waiver is permitted by law.
A claim for public injunctive relief or other relief that applicable law does not permit to be waived or determined in arbitration may proceed in court, but arbitrable individual claims may be completed first where permitted.
If AAA declines to administer a dispute because this clause does not comply with its consumer standards, the parties may agree to a compliant alternative provider. Otherwise, either party may bring the dispute in a court with jurisdiction.
Arbitration Opt-Out
You may opt out of this arbitration agreement by sending written notice to the address above or to office@benstravel.com within 30 days after first accepting these Terms. The notice must include your full name, contact information, acceptance date, and a clear statement that you opt out of arbitration. Opting out will not affect your access to Ben's Travel's services or the remaining Terms.
21. Governing Law and Court Venue
Except for the arbitration provision, which is governed by the Federal Arbitration Act, these Terms are governed by New Mexico law, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
When a dispute is properly heard in court rather than arbitration, the parties consent to jurisdiction in Bernalillo County, New Mexico. This does not require a consumer to surrender a forum or venue right that applicable law makes nonwaivable.
22. Changes to These Terms
We may update these Terms prospectively. The version presented and accepted for a consulting engagement or booking governs that transaction unless both parties agree to a later version.
Material changes will not retroactively alter an existing booking, refund right, liability, or dispute without legally sufficient notice and consent.
23. General Provisions
If part of these Terms is unenforceable, it will be modified only to the minimum extent necessary, and the remainder will continue in effect.
These Terms, the applicable consulting proposal, booking authorization, statutory disclosures, and supplier terms constitute the relevant agreements for the services they address. A transaction-specific document controls over inconsistent general language in these Terms.
Sections 7, 9, 14, 15, 17, 18, 19 through 21, and this Section survive completion or termination of an engagement as to any transaction they address.
Ben's Travel may send notices to you by email at the address you most recently provided or by mail to your most recent address. An emailed notice is treated as received on the day sent unless we receive a delivery failure. You are responsible for keeping your contact information current. Notices to Ben's Travel under Section 19 must be sent as that Section describes; other notices may be sent to the address or email in Section 24.
You may not assign these Terms or transfer a booking without our written consent and the applicable supplier's consent, and supplier rules generally control whether a reservation may be transferred or a name changed. Ben's Travel may assign these Terms to a successor in a merger, reorganization, or sale of substantially all of its assets, on notice to you. An assignment does not reduce your rights under these Terms or applicable law.
WorldVia, suppliers, and booking intermediaries are not parties to these Terms, and except as stated here these Terms create no third-party rights. Sections 13, 17, and 18 may be invoked by WorldVia and by Ben's Travel's owners, employees, and contractors as a defense to a claim those Sections cover. This paragraph gives no third party the right to enforce a payment obligation or to modify these Terms.
A failure to enforce a provision once is not a waiver of future enforcement.
Headings are for convenience and do not limit the Terms.
